Legislative and Regulatory Updates
NECA employs a Legislative Monitoring Intern to provide timely information on regulations and potential legislation that may affect the car wash/vehicle wash industry so businesses and the Association can respond effectively. During the month of July, NECA’s Intern reported the following activity that may be of interest to the car wash industry.

MASSACHUSETTS
HB 4863: An Act Relative to Business and Job Growth in the Commonwealth. This bill provides appropriations to several state aid agencies and grant programs relating to infrastructure development. It also makes important changes to the Massachusetts office of Business Development (MOBD) which currently works to retain and foster jobs in the state. Under the bill, the MOBD will be in charge of overseeing regional development plans and entering into public-private partnerships. The bill has gone through several phases and amendments.

HB 4827: An Act to Protect Groundwater Levels. This bill requires the secretary of the executive office of energy and environmental affairs to prepare and publish a map of present and formerly submerged lands and tidal flats. The map must also denote property lying within and abutting these zones. The map is then to be presented to the joint committee on environment, natural resources and agriculture for further action. HB 4838: An Act to conduct a study of chemicals infiltrating aquifers and bedrock fissures along the I 95 corridor. The act requires the Department of Transportation to study the short and long term impact of deicing chemicals used on state highways and to discover how sodium and chloride have entered state aquifers and groundwater wells. http://www.mass.gov/legis/bills/house/186/ht04pdf/ht04838.pdf

HB 4858: An Act Further amending chapter 407 of the acts of 1983 establishing the Mattapoisett River Valley Water Supply protection advisory committee. Under the bill, said committee shall be allowed to charge a fee to any town that withdraws water from the Mattapoisett river aquifer. The committee will also be allowed to issue bonds and notes so as to acquire land for the protection of the aquifer. Text can be found at:

HB 4889: An Order relative to authorizing the committee on Environment, Natural Resources and Agriculture to make an investigation and study of certain House documents. Under the Bill, the committee will sit during the legislature’s recess to make a study of house documents 693, 694, 707-13, 715, 719-20, 729-30, 733-35, 744-45, 750, 761, 763 and HB 3675. The majority of these documents concern vehicle emission programs and the bill is important only because it suggests the committee’s agenda for the next few months.

NEW HAMPSHIRE
Env-DW 720 Inspections; Significant Deficiencies: DES Water Division, Drinking Water & Groundwater Bureau. This proposed regulation from the Department of Environmental Services updates the existing rules for inspecting public water systems and reestablishes what constitutes a deficiency. The proposed rule also includes new sections to classify violations and clarifies the responsibility of privately owned distribution systems.
